Introduction

www.datamars.ie (the Site) is operated by Datamars IE, a division of Datamars Agri Ltd. The terms contained in this document (Trading Terms) apply to all transactions for the purchase of products from the Site. Please read these Trading Terms carefully before ordering. By placing an order on the Site, you agree to be bound by these Trading Terms. They form a legal agreement between you and us and can only be amended with our consent.

Your use of the Site is also subject to our Website Terms of Use and our Privacy Policy. We reserve the right to change these Trading Terms at any time without prior notice by updating them on the Site, though any changes will not affect purchases submitted before the update.

Ordering

You may place an order by following the onscreen instructions for the relevant product. You will be able to review and amend your order before confirming your purchase. All orders are subject to acceptance by us. We may decline your order for any reason and accept no liability if we choose not to supply.

Once your order is submitted, you will receive an acknowledgement email confirming receipt. This does not constitute acceptance. If an item is out of stock, we will contact you to discuss whether you wish to wait or cancel. Your order is accepted, and a contract is formed, only when you receive an email confirming that your products have been dispatched.

All product descriptions and technical information provided are intended as fair representations but cannot be guaranteed for accuracy.

Prices and Payment

Prices shown on the Site are listed in pounds (£GBP) or euro (€), depending on your region. £GBP prices are exclusive of VAT and delivery. € prices are inclusive of VAT but exclusive of delivery. Delivery charges and VAT (where applicable) are displayed during checkout.

Prices may change at any time prior to acceptance of your order. Payment must be made in full at the time of ordering. We accept most major credit and debit cards. By submitting card details, you confirm the card is yours. All cardholders are subject to validation and authorisation by their card issuer. If authorisation is declined, we cannot accept your order.

If a pricing error is found, we will contact you to confirm whether you wish to proceed at the corrected price. If not, or if we cannot reach you, the order will be cancelled unless dispatch has already occurred. All goods remain the property of Datamars Agri Ltd until paid for in full.

Delivery

Standard delivery is 3–5 working days. For special delivery requirements, please contact us on 01 4594664. Delivery charges are calculated during checkout.

We will make every reasonable effort to deliver products promptly once your order is accepted. Where possible, all items in your order will be delivered together. Orders are delivered to the address provided. Identification tag orders must be delivered to the address associated with your registered herd or flock number on AIM.

Deliveries occur Monday to Friday (excluding public holidays), typically between 9am and 5.30pm. Some deliveries may require a signature. Once delivered, the products become your property (if paid for in full) and responsibility. Except for damaged, faulty, or incorrectly delivered goods, we accept no liability for loss or damage after delivery.

Cancellations and Returns

You may cancel your order (or part of it) at any time before delivery, and up to 14 days afterwards. To cancel, you must contact us with your name, address and order reference, and return the products as described below. You do not need to give a reason.

You cannot cancel customised orders such as official identification tags once they have entered production. If goods differ from your order specifications, please contact us on 01 4594664 to arrange a return.

If you receive faulty goods, notify us within 48 hours of delivery. You may choose a replacement item (charged to your card) with the faulty item collected at our expense, or a refund upon return, subject to our confirmation that the item is faulty.

If cancelling after dispatch, products must be returned at your own cost and risk within 14 days, unused and in original packaging. Returns should be sent via An Post with proof of postage.

Upon accepted cancellation, refunds will be issued minus the original delivery cost.

Security

The Site uses secure sockets layer (SSL) technology to protect your payment data. All order and payment details are transmitted securely. Card data is sent directly to our payment provider (SagePay). We do not store card details.

Do not send payment details by email. We cannot be responsible for losses incurred from insecure transmission.

Our Liability

We are not liable where performance of our obligations is prevented by circumstances beyond our reasonable control. You are responsible for using products in accordance with all instructions and professional advice where relevant. We provide no guarantee and accept no liability for product efficacy or any consequential loss resulting from use. Your statutory rights remain unaffected.

Any legal notices should be sent to the above address. Failure to enforce a right does not constitute a waiver. You may not transfer your rights under these terms. If any part of these terms is unenforceable, the remainder will remain in force.

Irish law applies to these Trading Terms, and any disputes will be handled exclusively by Irish courts. Purchases can be concluded in English only.
